Governor Hochul has signed into law, as Chapter 693 of the Laws of 2022, a bill that requires all employment law notices that must be posted physically by employers now must additionally
be sent to all employees electronically.
The law took effect on December 16, 2022, and amended Section 201 of the New York State Labor Law. Employers must have digital versions of these documents made available through the employer’s Web site or by e-mail. Also, employers must provide notice to their employees that such documents required for physical posting are also available electronically. These requirements apply to all postings mandated by federal and state law, including items such as non-discrimination rights, unemployment rights, wage and hour laws, health and safety notices, etc.
Any employer found to be in violation of the amended law can be fined $100 for the first offense, fined between $100 and $500 for the second offense, and fined not less than $300 for all subsequent offenses.
