Governor Hochul Signs Patient Prescription Drug Discount Bill Into Law

On December 23, 2022, Governor Hochul signed into law, as Chapter 736 of the Laws of 2022, a bill – A.1741-A (Gottfried) / S.5299-A (Rivera) – that requires health insurers to apply patient discounts and other price reductions patients receive for prescription drugs against their deductibles and copayments for prescription drugs.  Insurers had been accused of warehousing these prescription drug discounts for their own benefit, while still charging patients full deductibles and copayments for prescription drug coverage.  The bill prevents that and will lower patient costs for prescription drugs.  The bill takes effect on January 1, 2023.  A copy of the bill can be read here: Patient Prescription Drug Discount Bill.  A copy of the Sponsor Memorandum explaining the bill can be read here: Sponsor Memorandum Patient Prescription Drug Discount Bill.  The Governor’s Approval Memo for the bill can be read here: Hochul Approval Memo on Prescription Drug Discount Bill.
