The United States Food and Drug Administration (FDA) has announced actions it is taking in light of the Centers for Disease Control and Prevention (CDC) issuing data showing high usage of electronic cigarettes (e-cigarettes) by middle school and high school students (see NYSDA blog post from October 6, 2022). FDA notes that all e-cigarettes on the market without the statutorily required premarket authorization are marketed unlawfully and risk FDA enforcement action and that it is illegal for a retailer or distributor to sell or distribute e-cigarettes that the FDA has not authorized.
