New York State Appellate Division, First Department, Affirms Partial Continuance of Dental Malpractice Case

The Appellate Division, First Department, of the New York State Supreme Court – in Castro v. Yakobashvilli – has partially affirmed the lower court denying the defendant dentist summary judgment on the basis that the plaintiff’s expert witness raised triable issues of fact that could go to trial for all teeth involved and on lack of informed consent, except for tooth #28 where summary judgment was granted the defendant dentist.  To read the complete court opinion in Castro v.
